Cycling Under the Influence

While some states prosecute cycling under the influence, or CUI / CWI, New Jersey does not. The DWI statute specifically refers to “ a person who operates a motor vehicle while under the influence of intoxicating liquor, narcotic, hallucinogenic or habit-producing drug…” The term motor vehicle is defined elsewhere in the statutes as including “all vehicles propelled otherwise than by muscular power, excepting such vehicles as run only upon rails or tracks and motorized bicycles.”

However, drivers of mopeds, motorized skateboards, or other “cycles” powered by a motor are subject to the DWI statute.
